The UK construction industries have experienced huge changes of legislative and policy environment over recent years. The users of the industry have been encouraged to adopt a partnering approach to their projects, new forms of contract and terms of engagement have been introduced and unprecedented statutory controls have been placed on commercial relationships. All of this necessitates specialist legal advisors who can help clients achieve their commercial goals, when faced with these challenges.

Osborne Clarke’s Construction team is one of the largest specialist teams based outside London. We advise on all contentious and non-contentious issues affecting the sector, acting for a wide cross-section of the construction and engineering community, in both the private and public sectors.

Our experience includes drafting and negotiating suites of construction documentation on a wide range of procurement methods, including PFI/PPP and LIFT. The projects on which we have advised have been diverse and cover both building and engineering developments. We ensure our clients' interests are safeguarded, whilst keeping a firm hand on commercial issues.

We regularly represent our clients in the resolution of construction disputes, using the full range of procedures and techniques, including alternatives to litigation. We understand that for our clients, cost predictability in disputes is very important. Where possible, we offer some of our services as product-based packages. We have extensive adjudication experience and regularly act for both claimants and respondents on claims of up to £10m to date. Our experience includes Dispute Adjudication Board procedures in international projects.

Our other specialist legal teams cover corporate, employment, commercial, tax and real estate matters.

Four of the team's lawyers have worked in the construction industry as quantity surveyors, which enables them to give added value in their advice to clients. One of our Partners is a practising adjudicator, author of the leading text 'Adjudication in Construction Contracts' and a former national Chairman of the UK Society of Construction Law. This activity ensures we remain at the leading edge of new legislative developments.

Our clients benefit, as we help them to anticipate and implement changes, which – in turn – maximise their business opportunities and minimise their risks.

“This flexible and personable firm has grown in profile… sound advice, … commercial and knowledgeable”.Chambers & Partners 2005
